ADGM adopts new Standard Contractual Clauses for Data Transfers

The Office of Data Protection of the ADGM has published new Standard Contractual Clauses (“SCC”) for data transfer. The SCC, which serve as a means for data transfer, follow the requirements regarding the transfer of personal data outside of ADGM as set out in the Data Protection Regulations of 2021, and further align with the corresponding European Union standards.

Aiming to provide a high level of data protection, the SCC cannot be amended by either party involved.

With the SCC in place, ADGM has repealed the 2015 transfer permits and further advised that it will no longer issue new permits. New entities established on or after 14 February 2021 rare given a transition period till 14 February 2022 to transition to the new conditions of the regulation.
